OPPORTUNITY
The Assistant General Counsel is responsible for supporting the Privacy &
Cybersecurity legal advisory function in the DaVita Privacy Office.
KEY ACCOUNTABILITIES AND RESPONSIBILITIES
Responsible for leading and supporting the Privacy & Cybersecurity legal
advisory function in the DaVita Privacy Office, including advising
DaVita\'s strategic lines of business and support functions, such as
Information Security and People Services
Lead a team of data privacy specialists, analysts, managers, attorneys
and support staff
Provide legal advice on data privacy and security (including
cybersecurity) laws and regulations with emphasis on the Health Insurance
Portability and Accountability Act of 1996 (HIPAA) Privacy and Security
Rules, the Health Information Technology for Economic and Clinical Health
Act (HITECH), all other U.S. federal (e.g., FTC, SEC) and state
data privacy and security laws concerning health, consumer, employee,
and other
Familiarity with EU GDPR, Brazil LGPD, and all other relevant privacy and
data protection laws and regulations, and collaboration with DaVita
International Privacy Lead as appropriate.
Provide advice on data privacy and information security frameworks and best
practices
Provide direction in developing and monitoring policies and processes to
assist business units in complying with data privacy and security laws and
regulations
Manage and oversee outside counsel engagement and support
Analyze complex data privacy and security regulatory issues and present
recommendations in oral and written form to senior executive leadership and
business operational leadership
Perform data privacy and security regulatory review on all aspects of the
business, including on IT clinical systems development, online and
marketing activities, and advising on conducting privacy impact assessments
Collaborate with IT teams to ensure that internal development of technologies
and services comply with applicable data security and privacy requirements
Support IT compliance with administrative, technical and physical safeguards
requirements
Lead and assist with negotiations of data privacy and security provisions in
internal and 3rd party contracts/agreements (including commercial
agreements, payor and hospital services partner agreements, and business
associate agreements)
Partner with various business teams to ensure that introductions of internal
or 3rd party technology or services comply with applicable data privacy and
security requirements, including review of related contractual agreements
Contribute and review data privacy education content and provide periodic best
practices updates to business leadership
Supervise and coordinate data breach responses, regulatory investigations,
and other legal/external inquiries regarding data privacy and security
Coordinate with legal and other teams on regulatory, risk, compliance,
and operational issues
QUALIFICATIONS AND REQUIREMENTS
Experience & Education:
J.D. Degree with minimum 8 years legal experience in HIPAA and other U.S.
federal and state privacy compliance
At least one privacy certification (CIPP/US, CIPT or CHPC) - attained
and maintained
At least one security certification (CISSP, HCISPP, Security ,
CCSP) - attained and maintained a plus
Experience managing a team of attorneys on data privacy and/or cybersecurity
matters required
Relevant experience in both a law firm and in-house or government regulator
setting preferred
