Job Description:

What's the role -

The Customs Compliance Manager ensures that Shell Chemicals is compliant with all Trade Control and fiscal regulations both internal and external to Shell. This position supports internal stakeholders in Shell Chemicals (Supply, Customer Centre, Logistics, Marine, Commercial), with respect to regulatory compliance related to International Trade, import / export transactions and cross border movements.

The Compliance Manager is accountable for regulatory trade compliance which includes US and Canada Customs import/export requirements, Free Trade Agreements, Drug precursor (DEA), and Dual-use product controls, in addition is the Chemicals contact for US Customs CTPAT Trade Compliance and related programs.

The Customs Compliance Manager is responsible for the development and maintenance of relationships with internal specialists (Product Stewardship and Product Quality), Shell’s Advisory Network for Trade Controls, Indirect Tax, Legal, Customs and the Global Chemicals Compliance Network. External stakeholders can include but are not limited to, Customs Authorities, DEA, BIS, Customs Brokers, freight forwarders and industry networks.

The Customs Compliance Manager is responsible for initiating and coordinating processes and procedures, effectively monitoring to ensure implementation with intent to increase regulatory compliance and understanding of risk/exposure and to initiate best practices.

Principal Responsibilities

Ensure customs clearance, declarations and payments are in compliance with US and Canadian Customs requirements (valuation, HS classification, country of origin, recordkeeping, etc.)

Partner with other functions within (HSSE, Logistics, Product Stewardship) Shell Chemicals to provide guidance from a trade compliance perspective.

Identify duty recovery opportunities (Drawback, GST, remissions, etc.)

Oversee Free Trade Agreement process, audit defense and management

Manage Trade Agent contracts and performance and conduct QBRs

Stay current with regulations and changes (retaliatory tariffs, USMCA, import/export regulations)

Responsible for annual review of product classifications according to the World Customs Organization, Canada and US Harmonized Tariff Schedule, along with classification of any new products or materials.

Develop, implement and maintain fit-for-purpose processes, controls and trainings as they relate to Customs Compliance.

Knowledgeable on global regulations in relations to S. America, Europe and Asia import procedures.

Implement and manage, as required, compliance programs and processes mandated by Group Trade Control Legal and the Downstream Trade Compliance Manager.

Provide first-line Trade Compliance support, advice and expert guidance to CRCs, Supply and Commercial on import / export regulations, Incoterms and records management.

Special Challenges

Rapidly changing and stricter regulations imposed by relevant Customs, Taxation, and other Government authorities

Take an active role in contributing to training and best practice sharing with relevant stakeholders.

Knowledge management and adherence to policies & processes in a dynamic environment.

Managing Trade Compliance updates and programs rolled out by Group Trade Control Legal and DS Trade Control Manager (Trade Control Manual updates and procedures)

Effectively manage relationships with various agencies and stakeholders in and outside of Chemicals.

Develop and maintain working relationships with Canadian and US agencies, external specialists and internal Shell personnel to ensure Shell is current and in compliance

Skills and Requirements

What we need from you -

Must have legal authorization to work in the US on a full-time basis for anyone other than current employer.

Minimum ten (10) years related work experience.

Must have at least a Bachelor's Degree.

Strong team player, relationship building, training, listening skills.

Familiarity with ACE and CADEX functionality and reports

Proactive and decision problem solver with good root cause analysis skills.

Mastery of relevant Customs and Trade Compliance legislation.

Flexible and open to change, eager to learn and develop.

Ability to quickly understand and apply knowledge in addressing the new and often complex issues arising from regulatory requirements

Extensive knowledge and broad experience in the fiscal, legal and regulatory aspect of the role

Ability to effectively interact with stakeholders at all levels of the organization

Familiarity with U.S. Department of Homeland Security programs including CTPAT Trade Compliance.

Mastery of inherent risks associated with cross border shipments including monetary penalties and reputation risk.

SAP knowledge preferred

Holder of a U.S License for Customs Broker preferred
